The justice ruled: CREDIDAM remains the sole collector for radio broadcasting until the issuance of a final judgment

On the 14^th of May 2014, in docket no. 1110/2/2013, the High Court of Cassation and Justice rejected the appeal filed by ARAIEX (Artists’ Association of Romania) against the Civil Judgment no. 1084/22^nd of March 2013, whereby the Bucharest Court of Appeal had rejected as unfounded, for the merits of the case, the request of ARAIEX for the suspension of Decision no. 4/2012 of ORDA (Romanian Copyright Office).

HCCJ rejected the appeal filed by ARAIEX against the designation of CREDIDAM as the sole collector for radio broadcasting until the issuance of a final judgment

On the 20^th of March 2014, in docket no. 902/2/2013, the High Court of Cassation and Justice rejected the appeal filed by ARAIEX (Artists’ Association of Romania) against the Civil Judgment no. 942/07^th of March 2013, whereby the Bucharest Court of Appeal had rejected as unfounded, for the merits of the case, the request of ARAIEX for the suspension of Decision no. 158/2012 of ORDA (Romanian Copyright Office).

The Bucharest Court of Appeal rejected the request of ARAIEX for the suspension of the decision whereby CREDIDAM was designated as the sole collector for the cable source

On the 18^th of February 2014, in docket no. 7714/2/2013 – trial won by ARAIEX (Artists’ Association of Romania), the Bucharest Court of Appeal, Administrative and Fiscal Contentious Section, rejected as unfounded the request for the suspension of Decisions no. 120/20^th of September 2013 and 121/20^th of September 2013 of ORDA (Romanian Copyright Office) (based on the two decisions mentioned above, CREDIDAM (Romanian Center for Performers’ Rights Management) was designated as the sole collector of the remunerations owed to performers and/or players from the cable – phonogram and audiovisual source).

Decision no. 712/13th of February 2014: HCCJ upheld the appeal filed by CREDIDAM against the Civil Judgment no. 2988/07th of May 2012

On the 13^th of February 2014, in docket no. 10989/2/2011, the High Court of Cassation and Justice upheld the appeal filed by CREDIDAM (Romanian Center for Performers’ Rights Management) against the Civil Judgment no. 2988/07^th of May 2012, issued by the Bucharest Court of Appeal, amending it in the sense that it accepted the action stated by CREDIDAM and it cancelled Decision no. 288/2011 of ORDA (Romanian Copyright Office) (as well as address no. 15444/2012 of ORDA).

By the above mentioned decision, ORDA granted a deadline for compliance with the law for the amendment of the CREDIDAM Memorandum of Incorporation.

On the 16^th of January 2014, in docket no. 837/2/2013, the High Court of Cassation and Justice rejected the appeal filed by ARAIEX (Artists’ Association of Romania) against the Civil Judgment no. 891/05^th of March 2013, whereby the Bucharest Court of Appeal had rejected as unfounded, for the merits of the case, the request of ARAIEX for the suspension of Decision no. 152/2012 of ORDA (Romanian Copyright Office).

On the 11^th of December 2013, in docket no. 1537/2/2013 – trial won by ARAIEX (Artists’ Association of Romania) wherein CREDIDAM (Romanian Center for Performers’ Rights Management) acted as forced intervener, the Bucharest Court of Appeal, Administrative and Fiscal Contentious Section, rejected as inadmissible the request filed by ARAIEX for the cancellation of Decision no. 158/2012 of ORDA (Romanian Copyright Office). Based on the decision mentioned above, CREDIDAM was designated as the sole collector of the remunerations owed to performers and/or players from the radio source.

On the 20^th of November 2013, in docket no. 6701/2/2013 – trial won by ARAIEX (Artists’ Association of Romania) wherein CREDIDAM (Romanian Center for Performers’ Rights Management) acted as intervener, the Bucharest Court of Appeal, Administrative and Fiscal Contentious Section rejected as inadmissible the request filed by ARAIEX for the suspension of Decisions no. 120/20^th of September 2013 and 121/20^th of September 2013 of ORDA (Romanian Copyright Office). Based on the two decisions mentioned above, CREDIDAM was designated as the sole collector of the remunerations owed to performers and/or players from the cable (phonogram and audiovisual) source.

The Bucharest Court of Appeal rejected the request of ARAIEX for the cancellation of decision no. 152/2012 of ORDA

On the 23^rd of October 2013, in docket no. 1536/2/2013 – trial won by ARAIEX (Artists’ Association of Romania) wherein CREDIDAM (Romanian Center for Performers’ Rights Management) acted as defendant, the Bucharest Court of Appeal, Administrative and Fiscal Contentious Section, rejected as unfounded the request for the cancellation of Decision no. 152/2012 of ORDA (Romanian Copyright Office). Based on the decision mentioned above, CREDIDAM was designated as the collector of the remunerations from the TV/phonograms source.

CNA forced Realitatea TV to grant the right of reply to CREDIDAM, in the show “Jocuri de putere”

Gathered in public session, further to an analysis of the reports prepared by the Inspection Service as a consequence of the claims received for the channels on the territory, the National Audiovisual Council decided on the application of the following sanctions:

The Council decreed on the issuance of a decision for the grant of the right of reply to CREDIDAM (Romanian Center for Performers’ Rights Management) in accordance with the provisions of art. 62 of the Audiovisual Cod, bearing in mind the show “Jocuri de putere”, broadcast by the Realitatea TV channel on the 20^th of September 2013.

Decision no. 6290/24th of September 2013: HCCJ rejected the appeal filed by ARAIEX against the Civil Judgment no. 3902/11th of June 2012

On the 24^th of September 2013, in docket no. 3914/2/2012*, the High Court of Cassation and Justice rejected the appeal filed by ARAIEX (Artists’ Association of Romania) against the Civil Judgment no. 3902/11^th of June 2012, issued by the Bucharest Court of Appeal, ordering the suspension of decision no. 56/2012 of ORDA (Romanian Copyright Office), decision whereby ARAIEX had been designated as the collector of the remunerations for the ambient source.
