On the 03rd of April 2013, in docket no. 719/2/2012, the Bucharest Court of Appeal, Administrative and Fiscal Contentious Section, ordered the CANCELLATION of Decision no. 304/28th of December 2011 of ORDA (Romanian Copyright Office), decision whereby ORDA granted to CREDIDAM (Romanian Center for Performers’ Rights Management) a 30 day deadline for compliance with the law.
On the 22nd of March 2013, in docket no. 1110/2/2013 – trial won by ARAIEX (Artists’ Association of Romania) wherein CREDIDAM (Romanian Center for Performers’ Rights Management) acted as intervener, the Bucharest Court of Appeal, Administrative and Fiscal Contentious Section, rejected as unfounded the request for the suspension of Decision no. 4/2013 of ORDA (Romanian Copyright Office). Based on the decision mentioned above, the rules of access for ORDA to the information system of the collective management bodies regarding the exercising of the reading function were established.
On the 15th of March 2013, in docket no. 2898/2/2012, the High Court of Cassation and Justice rejected the appeals filed by ORDA (Romanian Copyright Office) and ARAIEX (Artists’ Association of Romania) against the Civil Judgment no. 2749/25th of April 2012, issued by the Bucharest Court of Appeal, ordering the suspension of decision no. 37/2012 of ORDA, decision whereby ARAIEX had been designated as the collector of the remunerations for radio broadcasting/radio.
On the 15th of March 2013, in docket no. 5536/2/2012, the Bucharest Court of Appeal, Administrative and Fiscal Contentious Section, ordered the CANCELLATION of Decision no. 18/05th of March 2012 of ORDA (Romanian Copyright Office), whereby the Negotiation Commission for the public communication of phonograms and/or artistic performances from the audiovisual domain was established.
On the 07th of March 2013, in docket no. 902/2/2013 – trial won by ARAIEX (Artists’ Association of Romania) wherein CREDIDAM (Romanian Center for Performers’ Rights Management) acted as intervener, the Bucharest Court of Appeal, Administrative and Fiscal Contentious Section, rejected as unfounded the request for the suspension of Decision no. 158/2012 of ORDA (Romanian Copyright Office). By the decision mentioned above, CREDIDAM was designated as the collector of the remunerations from the radio source.
On the 05th of March 2013, in docket no. 837/2/2013 – trial won by ARAIEX (Artists’ Association of Romania) wherein CREDIDAM (Romanian Center for Performers’ Rights Management) acted as intervener, the Bucharest Court of Appeal, Administrative and Fiscal Contentious Section, rejected as unfounded the request for the suspension of Decision no. 152/2012 of ORDA (Romanian Copyright Office).
By the decision mentioned above, CREDIDAM was designated as the collector of the remunerations from the TV/phonograms source.
On the 04th of February 2013, in docket no. 9564/2/2012 – trial won by ARAIEX (Artists’ Association of Romania) wherein CREDIDAM (Romanian Center for Performers’ Rights Management) acted as intervener, the Bucharest Court of Appeal, Administrative and Fiscal Contentious Section, rejected as unfounded the request for the suspension of Decision no. 199/2012 of ORDA (Romanian Copyright Office).
By the decision mentioned above, decision no. 287/2011 regarding the access of the Romanian Copyright Office to the information system of the collective management bodies was revoked on the 16th of November 2012.
On the 25th of February 2013, in docket no. 5991/2/2012, the Bucharest Court of Appeal, Administrative and Fiscal Contentious Section, ordered the CANCELLATION of Decision no. 57/07th of May 2012, the third decision of ORDA (Romanian Copyright Office), whereby ARAIEX (Artists’ Association of Romania) had been designated as the collector of the remunerations from the radio source.
On the 21st of February 2013, in docket no. 5036/2/2012, the Bucharest Court of Appeal, Administrative and Fiscal Contentious Section, ordered the CANCELLATION of Decision no. 37/20th of March 2012, the second decision of ORDA (Romanian Copyright Office), whereby ARAIEX (Artists’ Association of Romania) had been designated as the collector of the remunerations from the radio source.
On the 12th of February 2013, in docket no. 3694/2/2012, the Bucharest Court of Appeal, Administrative and Fiscal Contentious Section, ordered the CANCELLATION of Decision no. 10/03rd of February 2012 of ORDA (Romanian Copyright Office), whereby ARAIEX (Artists’ Association of Romania) had been designated as the collector of the remunerations for radio broadcasting/radio.
