Starting with 22.12.2010, according to the Civil Decision no. 263A/16.11.2010, delivered by the Court of Appeal in Bucharest, 9th Civil Section and for issues related to intellectual property, in file no. 4009/2/2009, published in the Official Gazette, Part I, no. 861/22.12.2010, and based on the ORDA Decision no. 332/2010, respectively 333/2010, the new methodologies regarding the remunerations owed for the cable retransmission of works and of products bearing related rights, came into effect
According to the new methodology, regarding cable retransmission (ORDA Decision no. 327/15.12.2010), the remuneration to be paid to CREDIDAM amounts to:
0.75% from the calculation base for cable retransmission, performed after 21.12.2010.
The payment will be made in the IBAN CODE account: RO27INGB0001000152938983, opened at ING BANK – 1st District Subsidiary.

The remuneration represents only rights related to copyright and CREDIDAM was appointed as collector thereof, according to the ORDA Decision no. 332/23.12.2010 and to the ORDA Decision no. 333/23.12.2010.
Procedure for obtaining the license
- Fill in the authorization application and the licensing form.
-
Dispatch the signed and sealed application in 2 original counterparts, the signed and sealed license in 2 original counterparts and one copy of each of the following documents:
-
sole registration code (copy);
-
CNA authorizing decision/license (copy) – if applicable
-
CNA retransmission permit (copy);
-
MCTI technical authorization (copy);
-
ANRC certificate (copy);
-
- You will receive the license in original, signed and sealed by CREDIDAM.
-
Consign the monthly report, respectively pay the remuneration on the terms established by the methodology and by the license clauses.
MONTHLY REPORT (calculation base)
Transmit it till the 15th of the month following the month for which it is prepared, accompanied by a cover letter, signed and sealed by the legal representative, certifying on its own liability, the accuracy and reliability of the information included in the report and in the appended documents, and must contain the following:

list of retransmitted radio-broadcasting and/or television programs services;
-
number of subscribers;
-
subscription value;
-
calculation base (total amount of the monthly gross revenues obtained from the radio-broadcasting and/or television programs retransmission activities, and in the absence thereof, from the total amount of the incurred use expenses);

In case of payment delays, the users owe, according to the methodologies in force, penalties equivalent to 0.10% from the outstanding amounts, calculated per day of delay.

Ambient Users
For the use in the ambient environment (hotels, restaurants, bars, discos, transportation, etc.) of the performers’ interpretations, recorded on phonograms or in audiovisual format, they must obtain a license (authorization) from CREDIDAM, which will be issued after the completion of the following steps:

Download and fill in the enclosed STATEMENT and send it to the CREDIDAM headquarters;
-
Make the payment of the amounts stipulated in the tariff tables below, by bank wire transfer, to CREDIDAM, according to the respective category of use of the recorded artistic performances (phonograms or audiovisual);
-
After the reception, by CREDIDAM, of the type of contract corresponding to each work point, it will be filled in, signed, and returned to CREDIDAM (in two counterparts);
-
In relation to discos, it is necessary that, once the user fills in the Statement and signs the contract, a Financial Report should also be drafted, in the format presented below;
-
After the accredited person from CREDIDAM checks and signs the counterparts of the contract, one copy thereof will be returned to the address indicated by you.

*) When consulting the tables above, the (indoor or outdoor) net commercial areas will be considered, including the dancing rinks. If the same area is used for several activities, the remunerations owed (to collective administration bodies for the rights of performers and of phonogram producers) for public/working communication, will be paid for each and every activity, irrespective of the number thereof.
**) When consulting the tables above, the (indoor or outdoor) commercial areas will be considered, except for the annexed spaces (warehouses, storage spaces, sanitary spaces).
***) When consulting the tables above, the existence of radio-television equipments in rooms/spaces will be considered.
****) When consulting the tables above, for the means of transportation not used for more than 20 days a month, the due remuneration will not be charged. The recording in the table, for all types of transportation means, will be made only for those registered with the Romanian Registries, if applicable, vehicle, railway, naval or aerial registries.
The value of remunerations due for the use of music for working purposes
(low, average and high power devices or sound installations).
14. The calculation basis of the remunerations due for the public communication of phonograms in the public communication for working purposes (table L1) is represented by, if applicable:
1. Gross collected amounts from consumptions and sale of tickets, programs, advertising materials, etc.
In the absence thereof:
2. The expense budget of the manifestation.
3. The expense budget for advertising, promoting or electing campaigns.
15. If, within the same space, phonograms are communicated publicly, both for ambient and for lucrative purposes, remunerations for both uses will be paid, but they will not exceed 10% from the total gross revenues (table L2 and L3).
16. Occasional events, during which phonograms are communicated publicly, in a rate exceeding 40%, will be quantified by fixed percentages or amounts, as per the appended tables (table L1).
17. Users must obtain from the collective management bodies for the rights of performers or players and of producers of phonograms, the non-exclusive license for the public communication, for lucrative purposes, with at least 48 hours before the organized event or manifestation takes place.
18. Users will pay the equivalent value of the due remunerations upon the issuance of the non-exclusive license, in the case of fixed amounts, and within 5 days after the event or manifestation finishes, for percentage amounts.
19. In the case of users that organize recurrent tours or events, they may pay the due remunerations at the end of the tour or of the last event.
20. Users must submit, upon the request of collective administration bodies, at the end of the tour or of the last event, financial – accounting information and documents, indispensable for establishing the amount of the due remuneration.
21. For the correct distribution of the remunerations collected by collective administration bodies, the users must communicate the used play-list, by indicating the song title, the performer, the duration of use.
