HCCJ rejected the appeal filed by ARAIEX against the civil court decision dated the 19th of June 2013

On the 06^th of March 2015, in docket no. 1536/2/2013, the High Court of Cassation and Justice rejected the appeal filed by ARAIEX (Artists’ Association of Romania) against the civil court decision dated the 19^th of June 2013, whereby the Bucharest Court of Appeal rejected the suspension of decision no. 152/2012 of ORDA (Romanian Copyright Office) (whereby CREDIDAM (Romanian Center for Performers’ Rights Management) was designated as the collector for the TV phonograms source).

HCCJ rejected the appeal filed by ARAIEX against the Civil Judgment no. 3131/17th of October 2013

On the 30th of January 2015, in docket no. 2768/2/2013 (wherein the collective management body CREDIDAM (Romanian Center for Performers’ Rights Management) acted as intervener), rejected the appeal filed by ARAIEX (Artists’ Association of Romania) against the Civil Judgment no. 3131/17th of October 2013 (and against the court decision dated the 12th of September 2013). By the aforementioned Judgment, the Bucharest Court of Appeal ordered the cancellation of decision no. 5/2013 of ORDA (Romanian Copyright Office), whereby ORDA had granted to ARAIEX a deadline for compliance with the law.

On the 23rd of January 2015, in docket no. 476/2/2013 (docket wherein CREDIDAM (Romanian Center for Performers’ Rights Management) acted as intervener), rejected the appeal filed by ARAIEX (Artists’ Association of Romania) against the Civil Judgment no. 2222/02nd of July 2013, whereby the Bucharest Court of Appeal ordered the cancellation of decision no. 199/2012 of ORDA (Romanian Copyright Office).

On the 15^th of January 2015, in docket no. 5036/2/2012, the High Court of Cassation and Justice rejected the appeal filed by ARAIEX (Artists’ Association of Romania) against the Civil Judgment no. 793/21^st of February 2013, whereby the Bucharest Court of Appeal cancelled the second decision of ORDA (Romanian Copyright Office) issued for the radio source (respectively decision no. 37/2012 of ORDA).

On the 14th of November 2014, in docket no. 5991/2/2012, the High Court of Cassation and Justice rejected the appeal filed by ARAIEX (Artists’ Association of Romania) against the Civil Judgment no. 822/25th of February 2013, whereby the Bucharest Court of Appeal cancelled the last of the three decisions of ORDA (Romanian Copyright Office) issued for the radio source (respectively decision no. 57/2012 of ORDA).

The justice ruled: CREDIDAM remains the sole collector for cable

On the 03^rd of July 2014, in docket no. 7655/2/2013 – trial won by ARAIEX (Artists’ Association of Romania), the Bucharest Court of Appeal, Administrative and Fiscal Contentious Section rejected as unfounded the request filed by ARAIEX for the cancellation of decisions no. 120/20^th of September 2013 and 121/20^th of September 2013 of ORDA (Romanian Copyright Office) (based on the two decisions mentioned above, CREDIDAM (Romanian Center for Performers’ Rights Management) was designated as the sole collector of the remunerations owed to performers and/or players from the cable – phonogram and audiovisual source).

On the 04^th of June 2014, in docket no. 6472/2/2012, the High Court of Cassation and Justice rejected the appeal filed by ARAIEX (Artists’ Association of Romania) against the Civil Judgment no. 1457/24^th of April 2013, whereby the Bucharest Court of Appeal ordered the cancellation of Decision no. 62/2012 of ORDA (Romanian Copyright Office) (whereby the remunerations from private copy were transferred by the sole collector UPFR (Union of Phonogram Producers in Romania) to ARAIEX).
